IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN IN ARBITRATION, YOU AND PIZZA LUCE EACH WAIVE ANY RIGHT TO A JURY TRIAL AND ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
10.4 Small Claims Court Exception
Notwithstanding the arbitration agreement above, either party may bring an individual action in small claims court for disputes that fall within that court's jurisdictional limits, provided the matter remains in small claims court and proceeds only on an individual (non-class) basis.
